TERMS OF SERVICE

McG Studios Effective date: July 9, 2026

These Terms of Service ("Terms") govern your use of mcg-studios.com and your purchase of photography, videography, and related media services from McG Studios ("we," "us," or "our"). By using this site or booking our services, you agree to these Terms.

1. Services

McG Studios provides real estate photography, videography, aerial/drone imagery, virtual staging, floor plans, and related marketing media services in the North Shore and Chicago area. Package contents, pricing, and turnaround times are described on our pricing page and confirmed at booking. Totals shown on our booking form are estimates; final pricing is confirmed before the shoot.

2. Booking, Payment, and Cancellation

A booking is confirmed when we accept your request and confirm the shoot date. Payment is due upon delivery of final files unless otherwise agreed in writing. Delivered files remain licensed conditionally until payment is received in full.

Cancellations or reschedules made at least 24 hours before the scheduled shoot incur no fee. Cancellations with less than 24 hours' notice, or a locked/inaccessible property at the scheduled time, may incur a fee of up to 50% of the booked package.

Weather. Exterior, twilight, and aerial work depend on weather and light. If conditions prevent quality capture, we will reschedule the affected portion at no charge. Interior portions may proceed as scheduled.

3. Property Access and Preparation

The client is responsible for ensuring the property is accessible, photo-ready, and safe at the scheduled time. We photograph properties as presented; cleaning, decluttering, and physical staging are not included. Significant delays waiting for a property to become photo-ready may incur additional fees or require rescheduling. The client is responsible for obtaining any permissions needed from property owners or occupants for the shoot and for the marketing use of the resulting images.

4. Turnaround and Delivery

Standard turnaround begins at shoot completion and is measured in business days. Timelines for twilight, video, virtual staging, and aerial deliverables are confirmed at booking. Rush delivery is available as an add-on, subject to availability. Files are delivered through our online gallery platform; download links remain active for a limited time, and clients are responsible for downloading and backing up their files after delivery.

5. Image License and Copyright

All photographs, video, virtual staging imagery, floor plans, and other media we create are the property of McG Studios and are protected by copyright.

Upon full payment, the client receives a non-exclusive, non-transferable license to use the delivered media for the marketing and sale or lease of the specific property photographed, including MLS listings, listing sites, brochures, social media, and the client's own promotional materials related to that listing.

The license does not include: resale or redistribution of the media; use for a different property or listing; use by third parties (including builders, stagers, designers, contractors, or other agents) without a separate written license from McG Studios; or entry of the media into third-party datasets or AI training sets. MLS and listing platforms receive only the sublicense rights required by their terms for listing display.

McG Studios retains the right to use all media for portfolio, marketing, social media, advertising, and competition purposes. If you require confidentiality for a specific property, notify us in writing before the shoot and we will accommodate where possible.

6. Virtual Staging

Virtually staged images are digital renderings. They do not reflect the property's current physical condition, and included furnishings are illustrative only. The client is solely responsible for disclosing virtual staging wherever required, including MLS rules, advertising regulations, and disclosure laws. We recommend labeling virtually staged images as such in all marketing.

7. Aerial / Drone Services

Aerial imagery is captured by an FAA Part 107 certified remote pilot. Drone operations are subject to FAA regulations, airspace authorization, and weather. If airspace restrictions or conditions prevent safe, legal flight, the aerial portion will be rescheduled or refunded; other portions of the booking are unaffected.

8. Revisions and Reshoots

Delivered files include our standard professional editing. Reasonable correction requests (exposure, straightening, object touch-up) made within 7 days of delivery are included. Re-edits beyond standard corrections, additional deliverables, or reshoots requested for reasons within the client's control (property condition, staging changes, access issues) are billable. If a deliverable fails to meet the booked scope due to our error, we will re-edit or reshoot the affected portion at no charge.

9. Limitation of Liability

To the fullest extent permitted by law, McG Studios' total liability for any claim arising from our services or this site is limited to the amount paid for the booking giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost sales, or lost marketing opportunities. In the event of equipment failure, data loss, or other circumstances that prevent delivery, our liability is limited to a reshoot or a refund of amounts paid for the undelivered portion.

10. Indemnification

The client agrees to indemnify and hold McG Studios harmless from claims arising out of the client's use of delivered media outside the scope of the license, failure to obtain required permissions, or failure to make required disclosures (including virtual staging disclosures).

11. Website Use

The content of this website, including text, design, code, and imagery, is the property of McG Studios and may not be copied, scraped, or reused without written permission. You agree not to misuse the site or its booking forms.

12. Governing Law

These Terms are governed by the laws of the State of Illinois. Any dispute will be resolved in the state or federal courts located in Lake County or Cook County, Illinois.

13. Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the most recent version. Continued use of the site or booking of services after changes constitutes acceptance.
